| 内容記述 | 我が国における精神障害者に関する法制度の変遷をたどり、精神障害者が歴史的にどのように処遇されてきたかを明らかにする。精神障害者処遇の法制度は1900年に制定された精神病者監護法にはじまり、現在は精神保健及び精神障害者福祉に関する法律に至っている。その間、精神衛生法、精神保健法と名称も変化した。その変化は、精神障害者処遇の歴史でもある。この研究では、文献から法改正の背景と改正による患者処遇の変化、そして、その問題点を明らかにする。 | |||||

| 内容記述 | This study focuses on historical changes in Japanese law regarding people with mental disorders and clarifies how these changes have effected their treatment. The first law to deal with them was established as the Law to Control the Mentally Subnormal in 1900. It was changed to the Mental Hygiene Law and later amended to the Mental Health Law. Finally the Law related to Mental Health and Welfare of the Persons with Mental Disorders was enacted. The changes in the law have reflected the history of the treatment of people with mental disorders. In this study we reveal the background of these amendments, any revsions in the treatment of patients due to the amendments, and problems related to these changes by investigating pertinent documents in this area. | |||||
